The Council continues to press its slate of nine closures and ten federations despite serious flaws in the proposals and related argument exposed by campaigners. NASS continues to help. Liberal Democrat councillor, Peter Phillips, has learned from the DfE that the statutory guidance in which we and others have placed much faith is only something councils must "have regard to." NASS took up this matter with the DfE and we publish the substance of the reply, confirming our worst fears. Nevertheless the guidance exists and campaigners can always place on record flaws in procedures they observe and argue unreasonableness in any reference to School Adjudicators, Ombudsmen or High Court judges. Even these must accept that Councils need only "have regard to" the guidance.
